What happens when an employee refuses to sign a written warning?

Written warnings are more formal than verbal warnings, therefore, it serves as proof that the warning was given, but if an employee refuses to sign the warning, it does not invalidate the warning and the employer can provide proof that the warning was issued to the employee who refused to sign.

Do you have to sign a write-up from an employer?

Employees have to sign disciplinary documents. While it is a good policy to have some system that proves the employee was presented with the write-up, it is not required that the employee sign the document.

What should a supervisor do if an employee refuses to sign a performance appraisal form?

If the supervisor believes the information is accurate, yet the employee still refuses to sign the document, the supervisor should contact a third-party witness (i.e., another manager or someone in HR) to join the meeting. The witness will confirm that the employee is familiar with the document, yet refuses to sign it.

How do you respond to unfair write up?

What should you do if your boss asks you to sign a write-up, and you disagree with it or plan to dispute it? Ask for time to write a rebuttal, or sign the document with a note indicating you received and reviewed the write-up while noting that your signature does not indicate agreement with its contents.

No matter what your employer tells you, you are not required to sign a severance agreement, and you are not required to do so immediately. You always have the right to consult with a lawyer, even if you are sure you understand the terms.

Can you get fired for not signing a write-up?

Your employer can’t force you to sign the performance document, but there may be consequences for refusing to do so. For one, your employer could fire you for refusing to sign. For another, your refusal to sign may disqualify you from receiving unemployment benefits.

How long can a write-up Stay in your file?

Six Months. If they are going to be purged, figure they will be considered for about six months. Probably no one will take the paperwork out if the file, but the policy would generally be that if you didn’t cause trouble for six months, the previous writeups would not be considered against you.
